Privacy Policy

This privacy policy explains how Emma Holmes Art ("I", "me", "my") collects, uses, and protects your personal information when you visit [YOURWEBSITE.COM] (the "Site"), including when you browse the gallery and portfolio, sign up to my mailing list, or purchase prints or original artwork.

I am the data controller for the purposes of UK data protection law (UK GDPR and the Data Protection Act 2018).

1. Information I Collect

Information you give me directly

  • Newsletter sign-up: name and email address, when you subscribe via the sign-up form.

  • Orders and purchases: name, billing and shipping address, email address, and order details. Payment card details are collected and processed directly by my payment provider (see Section 4) — I do not see or store your full card details.

  • Enquiries: any information you include when you contact me directly, for example about commissions or general questions.

Information collected automatically

  • Analytics and cookies: when you browse the Site, cookies and similar technologies collect information such as your IP address, browser type, device type, pages visited, and how you interact with the Site. This is gathered through Squarespace's built-in analytics and Google Analytics.

  • Squarespace also automatically collects some technical data as part of hosting the Site (see Section 4).

2. How I Use Your Information

I use your information to:

  • Process and fulfil orders, including shipping and customer service

  • Send you the newsletter, if you've subscribed (you can unsubscribe at any time)

  • Respond to enquiries, including commission requests

  • Understand how visitors use the Site, so I can improve it

  • Meet legal obligations, such as tax and accounting records

3. Legal Basis for Processing

Under UK GDPR, I rely on the following legal bases:

  • Contract — to process your order and fulfil purchases

  • Consent — for newsletter sign-ups and non-essential cookies (you can withdraw this at any time)

  • Legitimate interests — for basic Site analytics, fraud prevention, and improving my services

  • Legal obligation — for record-keeping required by tax or consumer law

4. Sharing Your Information

I don't sell your personal information. I share it only with the service providers needed to run the Site and fulfil orders:

  • Squarespace — my website host and e-commerce platform, which processes data on my behalf, including order and account data.

  • Payment processor(s) (e.g. Stripe/PayPal, as used via Squarespace Payments) — processes your payment details directly. Please refer to their own privacy policies for how they handle your data.

  • Google Analytics — collects anonymised/pseudonymised browsing data to help me understand Site usage.

  • Shipping/courier providers — receive your name and delivery address to deliver your order.

  • Creative Hub — my Print on Demand provider will receive your name and delivery address to fufil your print orders.

Some of these providers are based outside the UK/EEA (for example, in the United States). Where this is the case, they provide appropriate safeguards for international transfers, such as Standard Contractual Clauses, as required under UK GDPR.

5. Cookies

The Site uses cookies for:

  • Essential functions — such as enabling the shopping cart and checkout (these can't be switched off, as the Site won't work properly without them)

  • Analytics — Squarespace Analytics and Google Analytics, to understand visitor behaviour

You can control or delete cookies through your browser settings. Note that blocking essential cookies may affect your ability to use the shop.

6. Data Retention

I keep your information only as long as necessary:

  • Order records are kept for as long as required by UK tax law (currently 6 years)

  • Newsletter details are kept until you unsubscribe

  • Enquiry correspondence is kept for a reasonable period to allow follow-up, then deleted

7. Your Rights

Under UK GDPR, you have the right to:

  • Access the personal data I hold about you

  • Correct inaccurate data

  • Request deletion of your data

  • Restrict or object to certain processing

  • Request a copy of your data in a portable format

  • Withdraw consent at any time (e.g. unsubscribe from the newsletter)

To exercise any of these rights, contact me at emma.holmes.art@gmail.com. If you're unhappy with how I've handled your data, you also have the right to complain to the UK Information Commissioner's Office (ICO) at ico.org.uk.

8. Children's Privacy

The Site is not directed at children, and I don't knowingly collect personal information from anyone under 16.

9. Changes to This Policy

I may update this policy from time to time, for example if I add new features or change service providers. The "Last updated" date at the top will reflect the most recent changes.
